El derecho de la competencia y el sector agroalimentario: retos actuales

La necesidad de promover la libre competencia y el correcto funcionamiento de los mercados es una realidad. Sin embargo, cuando la legislación de competencia conecta con el sector agrario surgen unas turbulencias que afectan a la OMC, a las políticas agrarias proteccionistas, que incluyen la PAC en Europa, y a unas excepciones agrarias de discutible vigencia y efectividad. En este entramado ocupa un lugar destacado la jurisprudencia del TJUE y la reciente Directiva 2019/633, que pretende regular las conductas desleales para asegurar el suministro agrario y alimentario.

The need to guarantee Antitrust law and the proper functioning of markets is a reality worldwide. However, when competition legislation connects with the agricultural sector, everything is getting confuse in the WTO, protectionist policies, which include the CAP in Europe, and agrarian exceptions of questionable validity and effectiveness. Within this framework, the jurisprudence of the CJEU and the recent Directive 2019/633, which aims to regulate unfair competition to ensure agricultural and food supply, occupy a main position.
