| dc.description.abstract | Abordaremos el estudio de la esclavitud infantil como forma de marginación extrema, analizando la evolución de la legislación, la jurisprudencia y la doctrina jurídica. En ocasiones, ejemplificaremos la praxis de determinadas realidades a través de testimonios recogidos de documentación de aplicación práctica del derecho. Tras una introducción, en la que reflexionaremos sobre las razones del tardío interés historiográfico por la infancia esclava, comenzaremos analizando la esclavitud infantil en los reinos peninsulares, inicialmente circunscrita a los moriscos y paulatinamente sustituida por los niños y las niñas negros traídos de África. A continuación, nos fijaremos en la esclavitud infantil en los dominios de Ultramar, tanto la practicada con los indios –observando la doctrina crítica de los autores del siglo XVI y las primeras medidas abolitorias de esa centuria–, como la de origen africano. Las últimas partes del estudio analizarán el comienzo de la abolición de la esclavitud en el mundo, a finales del siglo XVIII, en contraste con la revitalización del comercio esclavo en España. El proceso abolitorio español, marcado por la progresiva independencia de los territorios americanos, la presión internacional y el movimiento abolicionista, se alargó durante buena parte del siglo XIX. Una de las reivindicaciones por las que más se luchó fue la ‘libertad de vientres’, que argumentaba, contra la tradición jurídica de origen medieval, que la criatura de una madre esclava tenía que nacer libre. Aunque la esclavitud infantil desapareció en Cuba en 1886, todavía en el siglo XX se constatan niños y niñas esclavos en el Protectorado español de Marruecos, práctica denunciada por la Sociedad de Naciones. | es_ES |
| dc.description.abstract | We will approach the study of child slavery as a form of extreme marginalisation by analysing the evolution of legislation, jurisprudence and legal doctrine. Occasionally, we will exemplify the praxis of certain realities through testimonies collected from documentation on the practical application of the law. After an introduction in which we will reflect on the reasons for the late historiographical interest in slave children, we will begin by analysing child slavery in the peninsular kingdoms, initially confined to the Moors and gradually replaced by black children brought from Africa. We will then look at child slavery in the overseas dominions, both that practised on Indians –observing the critical doctrine of 16th century authors and the first abolitionist measures of that century– and that of African origin. The final parts of the study will analyse the beginning of the abolition of slavery in the world at the end of the 18th century, in contrast with the revitalisation of the slave trade in Spain. The Spanish abolitionist process, marked by the progressive independence of the American territories, international pressure and the abolitionist movement, lasted for much of the 19th century. One of the most fought for demands was ‘freedom of the womb’, which argued, against the legal tradition of medieval origin, that the child of a slave mother had to be born free. Although child slavery disappeared in Cuba in 1886, children were still enslaved in the Spanish Protectorate of Morocco in the 20th century, a practice denounced by the League of Nations. | en |
