La desheredación, ¿sistema necesitado de revisión?

El Derecho sucesorio común se rige por un sistema de legítimas que no ha sido objeto de revisión desde la fecha en la que el Código Civil fue promulgado en 1889. Antes las legítimas eran configuradas como instrumento para preservar la comunidad económica familiar pero hoy en día el modelo de familia y las estructuras económicas han evolucionado. Los márgenes de la libertad de testar son muy restringidos y la regulación de la figura de la desheredación está siendo cuestionada. A la hora de interpretar las causas de desheredación, los jueces se encuentran constreñidos por leyes que resultan obsoletas y poco ajustadas a la realidad socio-económica vigente. La idea de permitir una mayor libertad de testar, como sucede en Derecho sucesorio navarro, y de actualizar la figura de la desheredación, dotándole de márgenes más flexibles, va ganando adeptos en aras de garantizar la justicia distributiva familiar.

The common law of inheritance is governed by a system of legal rights that has not been revised since the date on which the CC was enacted. Previously, these legal rights were tools to preserve the family economic community, but nowadays, the traditional family model and economic structures have evolved. The margins of the freedom of testation are very restricted and the regulation of the figure of disinheritance has become obsolete. In interpreting the causes of disinheritance, judges are constrained by laws that have become outdated and are little suited to the current socio-economic reality. The idea is to allow greater freedom of testation similar to the inheritance law configured in Navarra, and update the figure of disinheritance, while providing more flexible margins. This proposition is gaining supporters with the aim of ensuring distributive family justice.
