Tutela de los derechos humanos frente al ruido

El ruido es una de las principales preocupaciones medioambientales, sanitarias y de orden público en las sociedades actuales. A pesar de la proliferación de vías para su protección, el paso decisivo en la lucha frente al ruido fue formulado por el Tribunal de Estrasburgo cuando admitió la posible afectación a un heterogéneo grupo de derechos fundamentales. El presente trabajo tiene como finalidad analizar críticamente los pasos seguidos por el Tribunal Europeo de Derechos Humanos en la tutela indirecta frente a esta forma de contaminación. En el marco del Convenio Europeo de Derechos Humanos, el artículo 8.1 relativo a la vida privada y familiar y al respeto del domicilio ha sido el verdadero impulsor del reconocimiento de obligaciones protectoras del ruido excesivo. En concreto, se analizan las condiciones materiales y procedimentales para entender vulnerado dicho precepto, si bien otros derechos humanos serán también estudiados en la medida en que han participado de esta importante labor jurisprudencial.

Noise is a major environmental, health and public order concern in modern societies. Despite the proliferation of ways to protect against this singular form of contamination, the decisive step in the fight against noise was made by the European Court of Human Rights when it admitted the possible involvement of a diverse group of fundamental rights. The aim of this paper is to critically analyze the steps taken by the European Court of Human Rights in indirect protection against noise. Under the European Convention on Human Rights, Article 8.1 refers to the right to respect for private and family life and home and it has been the real driving force behind the recognition of protective duties from excessive noise. This paper analyzes the different material and procedural conditions that determine the violation of article 8, although other human rights will also be studied to the extent that they have participated in this important jurisprudential work.
