| dc.description.abstract | El reconocimiento del notorio arraigo a favor de la Comunidad Bahá'í, por Orden PCM/1065/2023, de 18 de septiembre, es el primero que se hace en España, en el marco del Real Decreto 593/2015, de 3 de julio, transcurrida más de una década desde el último que se concedió a favor de la Iglesia Ortodoxa, a raíz del pleno de la Comisión Asesora de Libertad Religiosa de 15 abril del año 2010. En este contexto se hace necesario proceder a una revisión crítica de esta categoría jurídica, y de analizar su utilidad y limitaciones, así como de abrir una reflexión seria y serena sobre el estatuto jurídico de las confesiones religiosas con mera declaración de notorio arraigo, pero que carecen de un Acuerdo de Cooperación con el Estado, y de la conveniencia de impulsar una evolución del modelo jurídico español de libertad de conciencia y religiosa, hacia un sistema de derecho común, en que el Estado adopte una posición de exquisita neutralidad hacia las creencias religiosas de sus ciudadanos. | es_ES |
| dc.description.abstract | The administrative recognition of the notorious presence in Spain, of the Bahá’í Community, by Order PCM/1065/2023, of September 18th, is the first to be made in Spain, within the framework of the Royal Decree 593/2015, of July 3rd. More than a decade has passed since the last recognition of this notorious presence to the Orthodox Church, in the plenary session of the Advisory Commission on Religious Freedom, on April 15th, 2010. In this specific context, it is necessary to make a critical review of this legal category, and to analyze its usefulness and limitations, as well as to open a quiet and serious reflection on the legal status of those religious groups with a mere declaration of notorious presence in the country, but without a Cooperation Agreement with the State. It is also time for reflection over the convenience of promoting an evolution of the Spanish legal model of freedom of conscience and religion, towards a system of common provisions for all religious groups, and the adoption by the State of a position of exquisite neutrality towards the religious beliefs of its citizens. | en |
